She noted that the matter is significant because the builder sought to frame the dispute around documentation, whereas the core issue was the failure to deliver amenities promised to homebuyers. The non-provision of amenities including the pool, gym and spa was established through a joint inspection conducted in May 2026. Asha observed that the order carries an important message for developers: contractual documentation cannot simply be drafted to declare a promoter’s obligations as fulfilled and subsequently be relied upon as a shield against claims concerning promised amenities. She noted that the Karnataka RERA Authority recognised that such documents may be one-sided instruments prepared by the builder, which buyers often have little practical choice but to sign. For homebuyers, Asha highlighted that the order also provides reassurance that a genuine error, such as citing an incorrect project registration number, need not defeat an otherwise valid complaint where the project and promised amenities can be clearly identified from the record. Asha said: “At the end of the day, people don’t pour their life savings and years of loan repayments into a home just to get a bare plot with a signature on a deed.
