Shrusti Shah was quoted by ET Wealth Online in an article examining a recent Madras High Court decision involving sisters who claimed a 1/3rd share in their parents’ properties under Hindu succession law, but ultimately failed in their claim after the Court found that they had been “ousted” from the property.

Commenting on the principle of ouster, Shrusti explained that courts ordinarily do not infer ouster merely from the passage of time. According to her, ouster must be established through appropriate pleadings and evidence, which was the determining factor in the present case. She further noted that while one co-owner’s possession is ordinarily treated as possession on behalf of all co-owners, the legal position can change where ouster is specifically pleaded and proved.

Shrusti also highlighted practical steps that legal heirs should take to protect their rights in inherited property. She advised heirs to assert their share promptly following the death of the family head, including by issuing written notices, ensuring that revenue records and pattas are mutated in the names of all legal heirs, and maintaining documentary proof of any income received from the property. She further recommended that families record any partition or family settlement through a registered instrument rather than relying on informal arrangements. For parties seeking partition, she emphasised the importance of verifying the property schedule against the underlying title documents, as inaccuracies in the plaint may subsequently be relied upon against the claimant.
