Sunayana explains the legal principles governing succession to land granted by the Land Tribunal under the Karnataka Land Reforms Act, 1961. She shared her legal insights with ET Wealth Online on a Karnataka High Court ruling affirming the right of married Hindu daughters to claim their share in property established to be joint family property, including land granted by the Land Tribunal.

Explaining the legal reasoning behind the decision, Sunayana noted that the Karnataka High Court relied on settled judicial precedents recognising that married daughters are entitled to a share in land granted by the Land Tribunal. The Court held that the Hindu Succession Act, 1956, overrides the Karnataka Land Reforms Act, 1961, on the question of succession to such land.

Sunayana explained that the principal defence raised by the appellants was that the property had originally been tenanted land and was subsequently granted to the family’s predecessors by the Land Tribunal under the Karnataka Land Reforms Act, 1961. On this basis, they sought to deny the daughters a share in the property. However, the relationship between the parties and their claims through a common ancestor were not in dispute.

Commenting on the outcome, Mallik observed that the argument concerning the nature of the land had already been rejected in earlier judicial rulings. Further, the appellants were unable to displace the finding that the property continued to retain its character as joint family property. The Karnataka High Court consequently dismissed the second appeal, leaving undisturbed the trial court’s decree awarding each daughter a one-seventh share in the property.

The ruling reinforces the importance of established principles of Hindu succession law in determining inheritance rights and highlights that the marital status of a daughter does not, by itself, disentitle her from claiming her lawful share in joint family property.
