Adnan Siddiqui commented in ET Wealth Online on a recent Supreme Court ruling concerning a property dispute involving the identification of land, a rectification deed and the validity of a claim to title.

Adnan observed that the case of Venkatamuniyappa ultimately failed because it was premised on an assumption that was never established through evidence that land bearing Survey No. 1/4 and land bearing Survey No. 162 constituted the same property.

According to Adnan, the claimant’s own admission during cross-examination further weakened his case, as he acknowledged that the two survey numbers represented “totally different” properties. This admission, he noted, went to the heart of the claim and undermined its foundational premise.

Adnan further highlighted the significance of the 1997 rectification deed, on which the claim to Survey No. 162 was substantially based. He pointed out that the deed had been executed only by Venkatamuniyappa and his immediate vendor, Govindappa, and not by Thimmadasappa, the original seller under the 1971 transaction.

As Adnan explained, “Since Thimmadasappa never sold Survey No. 162, none of the subsequent buyers down the chain, including Venkatamuniyappa, could have acquired title to it, in keeping with the basic legal principle that nobody can pass on a title they never held.”

Adnan also pointed to the claimant’s conduct following the execution of the rectification deed. Despite asserting ownership from 1997 onwards, Venkatamuniyappa did not take steps to have the revenue records changed in his favour and instituted the suit only in 2007. According to him, this decade-long delay was an additional factor that the Supreme Court considered significant in assessing the claim.

Summing up the Supreme Court’s reasoning, Siddiqui said: “Taken together, the Supreme Court concluded that the Karnataka High Court had committed a jurisdictional error by affirming a decree built on assumption and conjecture rather than pleadings and evidence, and it restored the trial court’s original dismissal of the suit.”

The ruling highlights the importance of establishing a clear chain of title and proving the identity of the property in disputes concerning land records and title. It also highlights that a rectification deed cannot, by itself, confer title to property where the person from whom the title is purportedly derived never held or transferred such title.
