Property inheritance without a Will can raise several legal and procedural questions, particularly when multiple legal heirs have an interest in the inherited property or when one or more heirs wish to relinquish their share in favour of others. Addressing these aspects in an interaction with ET Wealth Online, Adnan Siddiqui shared insights on when a release deed may be required, the circumstances in which a Registrar may insist on such a document, and the legal remedies available to property owners.

Adnan explained that a release deed is generally necessary when property is shared among several legal heirs, as is common in cases of intestate succession or where heirs hold undivided shares, and one or more heirs formally wish to relinquish their share in favour of the others. He further advised that if a Registrar refuses to proceed without a release deed, the recommended course is to obtain a written legal opinion confirming that no release deed is required and submit it before the Registrar. If the Registrar’s office remains unconvinced, he noted that the aggrieved party may approach the jurisdictional High Court by way of a writ petition seeking directions to the Registrar to act on the Will.

Highlighting the importance of proper documentation, Adnan observed that executing a release deed can help prevent potential disputes or confusion in the future, particularly where other legal heirs may have a ‘colourable claim’ over the property. He emphasised that the deed should clearly identify the property concerned and record the releasor’s relinquishment of all rights, title and interest in it. The document must be executed by the releasing heir(s) and duly stamped in accordance with the applicable State Stamp Act.

The discussion highlights the importance of understanding the legal requirements surrounding property transfers and inheritance, and ensuring that the appropriate documentation is in place to minimise potential disputes among legal heirs.
