Commenting in a recent The Economic Times article, Shrusti observed that the High Court’s ruling extends beyond the immediate dispute and reinforces the welfare-oriented objective of the legislation. ![](https://ksandk.com/wp-content/uploads/senior-citizens-residence-rights.png) According to Shrusti, the father “won” in the sense that the High Court declined to interfere with the Tribunal’s order protecting his right to continue residing in his own home with dignity. While the underlying dispute over ownership of the property remains to be adjudicated separately, the Court recognised that the statutory protections available under the Act warranted immediate relief to safeguard the interests of the senior citizen. Shrusti explained that the judgment draws an important distinction between property ownership disputes and the rights conferred upon senior citizens under the Act. Even where questions relating to title remain unresolved, the legislation empowers courts and tribunals to ensure that elderly parents are not deprived of their residence, safety, or dignity while those disputes are being decided. She further noted that the decision reflects the welfare-centric approach adopted by the courts in interpreting the Act, ensuring that vulnerable senior citizens receive timely protection without requiring the final resolution of civil property proceedings.
