# Karnataka Shops and Commercial Establishments Amendment Act, 2026: Registration and Employer Compliance

Posted On - 28 October, 2026 • By - King Stubb & Kasiva

## **Introduction**

The Government of Karnataka has notified the Karnataka Shops and Commercial Establishments (Amendment) Act, 2026, through Notification No. DPAL 32 SHASANA 2026 dated September 4, 2026. The amendment, designated Karnataka Act No. 38 of 2026, came into force on September 4, 2026.

The amendment introduces changes affecting establishment registration, digital compliance processes, employee documentation and certain employer obligations. Businesses operating in Karnataka should review their existing registration arrangements and workplace practices to determine whether changes are required under the amended framework.

## **Changes to Establishment Registration**

The amendment introduces an exemption for establishments employing ten or more workers that are already registered under the Occupational Safety, Health and Working Conditions Code, 2020, subject to the statutory conditions.

It also removes periodic registration renewal requirements and provides for the digitisation of registration processes. These changes are relevant to employers managing multiple establishments or maintaining separate registration records for different locations.

Employers should assess whether their establishments fall within the amended exemption and ensure that any registration obligations that continue to apply are fulfilled. The exemption should not be assumed to remove every other applicable labour-law registration or compliance requirement.

## **Employee Documentation and Service Certificates**

The amendment introduces an obligation for employers to issue service certificates within seven days of receiving an employee’s application. It also prohibits employers from retaining employees’ original educational certificates, experience certificates and other documents.

Employers should review their onboarding, employee-record management and exit procedures to ensure that original documents are not retained in a manner prohibited by the amended law. Internal procedures should also provide for timely processing of employee requests for service certificates.

## **Employment of Women During Night Shifts**

The amendment revises certain conditions governing the employment of women during night shifts. Employers should examine the applicable statutory requirements and ensure that their shift arrangements, workplace safeguards and supporting procedures comply with the amended framework.

The precise conditions applicable to an establishment should be assessed against the amended statutory provisions and any relevant rules or directions.

## **Penalties and Employer Compliance**

The amendment also enhances penalties for certain statutory non-compliances. Employers should review their existing compliance processes, including registration records, employee documentation practices and procedures for responding to statutory requirements.

A practical compliance review should include:

- Confirming the establishment’s registration status and the applicability of any exemption.
- Reviewing electronic registration and record-keeping processes.
- Ensuring service certificates are issued within the prescribed seven-day period following an employee’s application.
- Reviewing the handling and retention of original employee documents.
- Assessing night-shift arrangements against the applicable conditions.
- Updating internal compliance checklists to reflect the amended provisions.

## **Conclusion**

The Karnataka Shops and Commercial Establishments (Amendment) Act, 2026, changes important aspects of establishment registration and employer obligations. Businesses operating in the state should review their registration status, employee documentation practices and workplace procedures to identify and implement any changes required under the amended framework.
