Overview
Germany has one of Europe's most influential competition law regimes. The Act against Restraints of Competition (Gesetz gegen Wettbewerbsbeschrankungen, GWB) addresses cartels, abuse of dominance, and merger control. The Bundeskartellamt (BKartA) is a pioneer in digital competition, having introduced Section 19a GWB (paramount significance for competition across markets) and the transaction value merger threshold. Germany applies both national and EU competition law in parallel. The 10th and 11th GWB amendments (2021, 2023) strengthened digital market provisions, enabling the BKartA to impose behavioural obligations on companies of paramount significance before abuse is established. Major cases include Facebook/Meta (data combination as abuse) and Amazon marketplace practices.
