Active EnforcementAct on Prohibition of Private Monopolisation and Maintenance of Fair Trade (Antimonopoly Act)
Authority: Japan Fair Trade Commission (JFTC) | Enforcement: Active | Enacted: July 1947
Overview
Japan's Antimonopoly Act (AMA), in force since 1947, is one of Asia's oldest competition statutes. The Japan Fair Trade Commission (JFTC) is an independent administrative agency with quasi-judicial powers. Japan has a distinctive surcharge (administrative fine) system for cartels and other violations, complementing criminal enforcement for serious cases. Recent developments include the Transparency Act for Digital Platforms (2020), the Mobile Software Competition Act (2024) targeting app store practices, and updated merger guidelines. Japan has been active in international cooperation and has pursued significant cases in the digital sector.
