Overview
Peru's competition framework is primarily governed by Legislative Decree 1034 of 2008, which addresses anti-competitive agreements and abuse of dominance. INDECOPI, through its Commission for the Defence of Free Competition (CLC), investigates and sanctions anti-competitive conduct. Peru is notable among Latin American jurisdictions for having no general merger control regime; pre-merger notification applies only to the electricity sector (Law 26876). The regime prohibits horizontal and vertical anti-competitive agreements and abuse of dominant position. INDECOPI has been increasingly active in enforcement, particularly in the pharmaceutical, fuel distribution, and public procurement sectors. A leniency programme was introduced in 2016 (Legislative Decree 1205). While the absence of general merger control has been the subject of policy debate for over a decade, legislative proposals to introduce one have not yet been enacted.
