Adnan Siddiqui Comments on Delhi High Court Ruling on Unregistered Family Settlements and Property Ownership Rights

Adnan Siddiqui recently shared his insights in an Outlook Money article examining a significant Delhi High Court judgment concerning property ownership disputes and the legal validity of unregistered family settlements.
Commenting on the facts of the case, Adnan noted: “The dispute involved a Model Town-III residential property where the defendants tried to resist a partition suit by claiming an oral gift and an oral partition from nearly thirty years ago. The Court rejected both. The plaintiff walked away with a 5/6th share, backed by four registered relinquishment deeds from his sisters. The defendants had possession-based claims and family assertions but it did not cross the evidentiary threshold.”

The judgment discusses the importance of proper documentation and registration when dealing with family property arrangements. While family settlements can play a crucial role in resolving disputes, the decision highlights that claims based solely on oral arrangements or long-standing possession may not be sufficient to establish ownership rights where statutory requirements and documentary evidence point otherwise.
The ruling also reinforces a broader principle in property law: registered instruments and legally recognized transfers continue to carry significant evidentiary value in ownership disputes, particularly in partition and succession-related matters.
