Aniket Ghosh Highlights Increasing Regulatory Scrutiny in Alleged Media Cartelisation Investigations

Amid growing discussions surrounding the alleged media cartelisation matter involving the Advertising Agencies Association of India (AAAI), legal expert Aniket Ghosh has highlighted the evolving investigative approach being adopted by competition regulators in India.
Speaking to exchange4media, Aniket Ghosh observed that investigative authorities, particularly the Director General (DG) under the Competition Commission of India (CCI), increasingly rely on a combination of documentary evidence and circumstantial material while examining allegations of anti-competitive conduct.
“The DG typically relies on a combination of documentary and circumstantial material, circulars, advisories, model agreements, meeting minutes, internal emails and WhatsApp chats between office-bearers and member firms, and any data-sharing arrangement run by the association,” Aniket stated in the report.
His remarks come at a time when regulatory scrutiny over industry associations, media buying arrangements, advertising practices, and coordinated commercial conduct is intensifying across sectors in India.
