Aurelia Menezes Comments on Intermediary Liability in Offshore Betting Advertisements in Storyboard18

Aurelia Menezes was recently quoted in an article published by Storyboard18 discussing the growing concerns around offshore betting advertisements appearing on social media platforms and the legal responsibilities of digital intermediaries.

The article titled “Brand clones, cash bonuses: Real Money Gaming firms raise alarm over offshore betting Ads on social media” examines the regulatory and legal implications of offshore betting operators promoting their services through social media channels, often targeting Indian users.
Commenting on the issue, Aurelia highlighted the evolving question of intermediary liability under Indian law. She noted that social media platforms may face legal scrutiny if they fail to exercise the due diligence required of intermediaries under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
Aurelia explained that while digital platforms generally benefit from safe harbour protection, this protection is conditional and depends on whether the intermediary acts responsibly once it becomes aware of unlawful content. She emphasized that if misleading or illegal gambling advertisements continue to run on platforms, or are not removed after being reported, it raises significant legal concerns.
According to Aurelia, such inaction may lead to questions about whether platforms are indirectly facilitating unlawful betting activities or enabling advertisements that mislead users. The issue is particularly significant in the context of offshore betting platforms that operate outside India’s regulatory framework while using digital platforms to reach domestic audiences.
