Aniket Ghosh Offers Legal Perspective on CCI Price Collusion Findings in BusinessLine Article

In a recent article published by The Hindu BusinessLine titled “Steel cos have a strong case against CCI price collusion findings”, Aniket Ghosh provided important legal insight into the Competition Commission of India’s findings on alleged price collusion in the steel sector.

Commenting on the issue, Aniket observed that the matter warrants a cautious and balanced assessment, particularly in light of established principles of Indian competition law. He highlighted that parallel pricing in a commodity-driven and cyclical industry such as steel does not, by itself, constitute cartelisation, especially where pricing behaviour may be influenced by common cost structures, regulatory factors, or market forces.
Aniket further noted that Indian jurisprudence has consistently recognised the distinction between anti-competitive agreements and legitimate market-led price alignment. According to him, conduct driven by economic realities or regulatory frameworks cannot automatically be presumed to violate competition law in the absence of clear evidence of collusion or concerted practice.
His comments contribute to the broader legal discourse on how competition authorities should assess pricing behaviour in industries characterised by cyclical demand, and cost-linked pricing mechanisms.
