Adnan Siddiqui Shares Insights on Delhi HC Ruling in ₹2.27 Crore Property Dispute

Adnan Siddiqui shared his insights with ET Wealth Online on a recent Delhi High Court judgment directing a brother-in-law to pay ₹2.27 crore to his sister-in-law towards her share of the proceeds from the sale of 26 bighas of land in Najafgarh.

Siddiqui noted that the Court’s reasoning rested substantially on the brother-in-law’s own documentary record, particularly the registered General Power of Attorney (GPA) and the sale deed. The registered documents identified Mrs Mehta and the other sisters-in-law as “Vendors” and “absolute owners/bhumidars” of the Najafgarh land. In Siddiqui’s view, having executed these documents, the brother-in-law could not subsequently contend, without supporting evidence, that the property actually belonged exclusively to him and his wife.

A significant aspect of the dispute was the brother-in-law’s claim that the amount received by Mrs Mehta represented repayment of a loan rather than her share of the sale consideration. Siddiqui pointed out that Mrs Mehta had declared the amount in her income-tax return as long-term capital gains arising from the sale of the property and had paid tax on it. This, according to Siddiqui, directly contradicted the subsequent “loan” explanation.

Adnan further highlighted that there was no promissory note or other documentation evidencing the alleged loan, while the brother-in-law’s own versions regarding the mode of transfer of the alleged loan amount were inconsistent, including references to a cheque and a bank transfer. The Delhi High Court consequently rejected the defence as a “moonshine defence”.
