Abhishek Bagga Shares Insights with Times Now on E-Commerce Platforms’ Liability for Mandatory Product Disclosures

Abhishek Bagga recently shared his views with Times Now on the legal obligations of e-commerce platforms to display mandatory product information, particularly expiry and best-before dates for regulated products sold online.

Commenting on the applicable legal framework, Abhishek explained that the Legal Metrology (Packaged Commodities) Rules, 2011, read together with the Consumer Protection (E-Commerce) Rules, 2020, impose an independent obligation on e-commerce platforms to ensure that mandatory product declarations are displayed on online listings before consumers make a purchase.

Further elaborating on the issue, Abhishek noted that where products such as food items, health supplements and certain cosmetics are legally required to carry an expiry, best-before or use-by declaration, the corresponding information should ordinarily be made available on the product listing itself. He also highlighted that this obligation is not merely incidental to the seller’s responsibilities.

Abhishek observed that under the Legal Metrology (Packaged Commodities) Rules, e-commerce platforms have an independent statutory duty to display mandatory declarations, including expiry or best-before dates wherever applicable. Consequently, a failure to comply with these disclosure requirements may expose the platform to regulatory liability separate from that of the seller.

As online marketplaces continue to play an increasingly significant role in consumer purchases, the legal framework places greater emphasis on transparency and informed decision-making.
