Adnan Siddiqui Shares Insights on Preventing Inheritance Disputes Through Effective Estate Planning

Adnan Siddiqui has shared his insights on inheritance disputes and estate planning in a recent feature examining common mistakes families should avoid while planning the succession of their assets.
Highlighting that inheritance disputes often arise from a lack of documentation and delayed conversations rather than deliberate ill will, Adnan observed, “Very few inheritance disputes begin with ill will. Many start with a missing document or a conversation that was repeatedly postponed.”
He emphasised the need for additional care when a parent is elderly or unwell while preparing a Will. The close involvement of a principal beneficiary in drafting or preparing the Will may subsequently give rise to allegations of undue influence or suspicious circumstances. Siddiqui also explained that while a Will is an effective succession planning instrument for self-acquired property, it may be challenged on legally recognised grounds, including lack of testamentary capacity, coercion or suspicious circumstances.

Adnan further recommended documenting the rationale behind unequal distribution of assets, particularly where such decisions are based on factors such as financial assistance provided to a family member, caregiving responsibilities or contributions to a family business. Such documentation can help family members understand the testator’s intentions and reduce the scope for disagreements.
Suggesting practical approaches to balancing the interests of family members, he noted that one child could receive the family home while another receives financial assets of comparable value. Such arrangements, when carefully structured and documented, can help families plan succession while minimising the potential for future disputes.
The feature highlights the importance of proactive estate planning, legally sound Will preparation and clear communication in preserving family relationships and preventing inheritance-related litigation.
