What Borrowers Can Do If a Lender Forcibly Repossesses a Financed Vehicle: Siddartha S. Karnani

Borrowers whose financed vehicles are forcibly repossessed by lenders have avenues to raise a grievance and seek redressal, said Siddartha S. Karnani in a recent Business Standard feature. He highlighted the importance of first approaching the lender through its formal grievance redressal mechanism.

Siddartha said borrowers should submit their complaint in writing to the lender’s Grievance Redressal Officer or Principal Nodal Officer. If the lender rejects the complaint, provides an inadequate response, or fails to respond within 30 days, the borrower may approach the RBI Integrated Ombudsman through the Complaint Management System (CMS) portal, subject to the applicable framework.
The process provides borrowers with a formal channel to challenge concerns relating to the manner in which a financed vehicle has been repossessed and seek appropriate redressal. Karnani’s comments underline the importance of documenting the grievance and following the lender’s prescribed escalation mechanism before approaching the banking ombudsman framework.
