Commenting on the implications of the amendment impacting lifetime trusteeships, Jagtap observed that while the law introduces stricter compliance standards, it does not impede continuity in leadership. She noted, “The board can still appoint trustees with fixed terms – renewable every few years, subject to performance and board approval.”

Highlighting the compliance lens, she added, “Since the Trusts are registered in Maharashtra, this statutory change applies to them, and lifetime appointments, even if previously resolved by the Trust, may now be vulnerable to legal scrutiny or deemed non-compliant.”

Gauri’s analysis focuses on the need for trusts to revisit their governance structures to ensure alignment with the updated legal framework, while also preserving leadership stability and institutional integrity.
