Sukrit Kapoor Highlights Supreme Court Ruling Strengthening Homebuyers’ Right to Compensation Despite Taking Possession

The Supreme Court has reaffirmed crucial protections for homebuyers by holding that accepting possession of a delayed property does not deprive consumers of their right to seek compensation for the delay. The ruling also highlights that consumer complaints cannot be routinely diverted to arbitration without proper judicial examination, reinforcing the jurisdiction of consumer forums in such disputes.

Commenting on the judgment, Sukrit Kapoor said:

“The Supreme Court held that the NCDRC failed to examine whether the consumer complaint, once admitted, could legally be referred to arbitration. More importantly, it ruled that taking possession of the flat does not extinguish a homebuyer’s right to seek compensation for delayed possession, as the claim relates to the period before the property was handed over.”

Sukrit noted that the decision provides significant clarity on the interplay between arbitration clauses and consumer protection laws, ensuring that procedural technicalities do not override substantive consumer rights.

Highlighting the broader impact of the ruling, he added: “The judgment ensures that buyers have the opportunity to pursue their claims before consumer forums rather than having them dismissed on technical grounds. It will particularly benefit homebuyers who accept possession after prolonged delays, while also limiting the ability of developers to rely on arbitration clauses to keep buyers away from consumer courts.”

The ruling is expected to strengthen consumer confidence in the real estate sector by reaffirming that compensation claims for delayed possession survive even after the homebuyer takes possession of the property. It also reinforces the role of consumer forums in adjudicating such disputes, ensuring that contractual arbitration clauses do not automatically curtail statutory consumer remedies.
