K Vidya Shares Insights with Business Standard on the Relevance of the Insolvency and Bankruptcy Code

K Vidya was recently featured in Business Standard, where she offered her perspective on the evolving role of the Insolvency and Bankruptcy Code, 2016 (IBC) in India’s corporate restructuring landscape.
Commenting on whether the IBC is losing its relevance amid the growing preference for out-of-court settlements, Vidya observed:
“I don’t think the IBC is losing relevance. If a faster and commercially viable settlement is possible outside the IBC, many lenders are understandably choosing that route.”

Her remarks highlight that the increasing use of alternative resolution mechanisms reflects commercial pragmatism rather than a decline in the significance of the IBC. While lenders may opt for quicker and more cost-effective settlements outside the formal insolvency framework where feasible, the IBC continues to remain a critical legal mechanism for resolving corporate distress, preserving value, and ensuring creditor protection in appropriate cases.
