Adnan Siddiqui Comments on Will Registration in India in Economic Times

Adnan Siddiqui was quoted by ET Wealth Online in its article examining whether registration of a Will is mandatory in India.

Adnan clarified that registration of a Will is not compulsory in India, irrespective of the testator’s religion, with certain nuances under Muslim personal law. He noted that this position applies to Hindus, Christians and Parsis as well.

While registration is not mandatory, Adnan advised that testators should consider registering their Wills voluntarily wherever possible. He noted that registration can help deter allegations of forgery or backdating, safeguard the original document from loss or destruction, and simplify subsequent proceedings involving probate, letters of administration or contested succession.

“The cost and minor procedural inconvenience of registering a Will are almost always outweighed by the certainty it buys the family after the testator’s death,” he said.
