Shrusti Shah Shares Insights with Outlook Money on Karnataka RERA’s Landmark Ruling on Developers’ Continuing Obligations

Shrusti Shah, Principal Associate, KSK was recently featured by Outlook Money, where she discussed the significance of a recent Karnataka Real Estate Regulatory Authority (K-RERA) decision reaffirming that a developer’s obligations continue even after handing over possession of a property.

Commenting on the ruling in Yoganandan Jagannathan v. Smart Value Homes (Peenya Project) Private Limited & Anr., Shrusti explained that the decision reinforces one of the core objectives of the Real Estate (Regulation and Development) Act, 2016 to ensure accountability of promoters beyond the stage of possession.

She observed: “Karnataka RERA’s order in Yoganandan Jagannathan v. Smart Value Homes (Peenya Project) Private Limited & Anr. marks a significant reaffirmation of the promoter’s continuing obligations under the RERA Act. It has been laid down by the Authority that the responsibilities of the developer do not terminate upon the handing over of possession. Completion of amenities as promised needs to be carried out, and common areas, project assets, statutory connections, and funds collected from homebuyers need to be transferred to the Association of Allottees at the earliest.”

Shrusti further highlighted that the ruling strengthens the rights of homebuyers by making it clear that possession alone does not discharge a developer from its statutory responsibilities. Promoters remain accountable for fulfilling their commitments under the project, including completing promised amenities, transferring common areas and project assets, facilitating statutory connections, and handing over funds collected for the benefit of the Association of Allottees.

The decision serves as an important reminder to developers that compliance under the RERA framework extends beyond project delivery and continues until all statutory and contractual obligations have been fulfilled. At the same time, it provides greater clarity and protection for homebuyers seeking timely completion of common infrastructure and proper transfer of project management.
