Deepika Kumar Highlights Legal Consequences of Visa and Passport Fraud Under Bharatiya Nyaya Sanhita, 2023

In the wake of a major crackdown on visa and passport fraud, the Delhi Police have arrested over 130 agents in 2025 for their alleged involvement in running illegal and unlicensed immigration operations. The development casts light on the growing enforcement focus on immigration-related offences and organised fraud networks in India.

Commenting on the legal implications of such activities, Deepika Kumar, in a recent Business Standard article titled “Visa, passport fraud in India: Delhi Police arrest 130-plus agents in 2025”, highlighted that operating unlicensed immigration services can have serious criminal consequences under India’s new criminal law framework.

Deepika Kumar noted that such acts may attract charges of cheating under Section 316 of the Bharatiya Nyaya Sanhita, 2023, and, in aggravated cases, may also invoke human trafficking provisions under Sections 359 and 360, depending on the nature and scale of the offence. Her comments bring attention to the expanded scope and stricter treatment of organised immigration fraud under the revamped penal regime.
