Dhruv Kaushal Highlights Legal Risks of Dark Patterns in Digital Commerce

In a recent interaction with Business Standard, Dhruv Kaushal, emphasized the growing regulatory scrutiny surrounding the use of dark patterns in online commerce. He noted that dark patterns are designed to “subvert or impair consumer autonomy, decision-making or choice,” often influencing users into making decisions they may not have otherwise intended.

Dhruv further explained that the Guidelines for Prevention and Regulation of Dark Patterns, 2023, issued under Section 18 of the Consumer Protection Act, 2019, establish a broad prohibition against the use of such deceptive design practices. According to him, businesses engaging in dark patterns may expose themselves to allegations of unfair trade practices, misleading advertisements, and violations of consumer rights.

His comments highlight the increasing importance of informed consent and fair user interface design as regulators continue to strengthen consumer protection measures in India’s digital economy.
