Nivedita Bhardwaj Highlights Legal Risks in Poorly Drafted Wills in Business Standard Feature

In a recent article published by Business Standard titled “What to Avoid in a Will: Unequal Shares, Coercion, Vague Language”, Nivedita Bhardwaj shared key legal insights on the importance of clarity and due process in the drafting and execution of Wills. 

Poorly Drafted Wills

Commenting on the risks of vague or ambiguous testamentary language, Bhardwaj stated: 

“If the terms of the Will are vague or insufficiently definite, it is considered void and may be contested in court.” 

She further noted that in the event of a legal challenge, the burden falls on the challenger to substantiate their claims with credible evidence. At the same time, beneficiaries must demonstrate that the challenge lacks legal standing or is motivated by personal gain. 

Emphasizing procedural safeguards, nivedita added: 

“At least one attesting witness must testify in court to validate the signature. It must also be proved that the testator was of sound mind and acted voluntarily, free from coercion or influence.”
