NCDRC Awards ₹20,000 Compensation to Railway Passengers, Highlights Need to Substantiate Loss

The National Consumer Disputes Redressal Commission (NCDRC) awarded ₹20,000 as consolidated compensation to railway passengers who were allegedly robbed at gunpoint during a train journey, after finding the Railway Administration deficient in service for failing to provide reasonable safety and security to passengers travelling in a reserved coach.

Commenting on the decision, Abhishek Bagga said that the NCDRC did not uphold the ₹65,000 compensation awarded by the District Consumer Commission, as the petitioners could not conclusively establish the quantum of loss claimed. “In view of the evidentiary discrepancies, while recognising the likelihood of some loss, the Hon’ble NCDRC awarded ₹20,000 as consolidated compensation towards loss, mental agony and litigation expenses,” Bagga said.

Bagga noted that the decision highlights the importance of supporting claims for compensation with credible evidence. While a deficiency in service may be established, the quantum of monetary loss claimed must also be substantiated through adequate and consistent evidence.
