Adnan Siddiqui Comments on RERA Liability for Structural and Workmanship Defects
Adnan Siddiqui was quoted by ET Wealth Online in its report on a Telangana RERA ruling concerning a homeowner’s claim against a builder for roof leakage.
Commenting on the distinction between structural and workmanship defects under the RERA framework, Adnan noted that the RERA Act does not define either term, leaving scope for interpretation through decisions of tribunals and courts.
He explained that a structural defect concerns the integrity of the building itself, including its foundations, load-bearing columns, beams and slabs, and involves failures that may affect the safety and habitability of the building.
Adnan further observed that workmanship defects are broader and relate to how construction has actually been carried out, including whether materials and specifications were properly applied and whether the finished work performs as intended.
“Poor waterproofing, defective tiling, inadequate grouting, faulty plumbing, none of these compromise the building’s structure, but all of them reflect a failure in execution that RERA holds developers accountable for,” he said.
His comments highlight the scope of developer liability under RERA and the importance of distinguishing between structural defects and deficiencies in construction workmanship.
