In a recent article published by Storyboard18 titled “Hulk Goes Rogue: AI superheroes now promote illegal betting and gambling platforms”, Arpit Choudhary, shared key legal insights on the growing misuse of AI-generated characters and digital endorsements in promoting illegal betting and gambling platforms.

AI-Driven Betting Promotions

Commenting on the issue, Arpit Choudhary stated that Indian law unequivocally prohibits the promotion of illegal betting and gambling, regardless of whether such endorsements are made by celebrities, social media influencers, or AI-generated fictional characters. He emphasised that the absence of a standalone AI-specific statute does not create a regulatory vacuum. According to him, existing legal frameworks including the Consumer Protection Act, 2019, the CCPA’s advertising guidelines, the Information Technology Act, 2000, and intermediary rules squarely apply to misleading, unlawful, or deceptive promotions carried out through digital and AI-enabled tools.

Arpit further cautioned that the use of popular fictional characters, particularly well-known superheroes, to promote betting platforms especially in regional languages significantly amplifies legal risk. He noted that such practices may give rise not only to advertising and consumer protection violations, but also to copyright infringement, trademark misuse, and deceptive trade practice claims. Importantly, he clarified that liability in such cases attaches not to the fictional character, but to the real individuals or entities operating the accounts and orchestrating the promotions.

His comments add an important legal perspective to the evolving conversation on AI, advertising accountability, and platform responsibility, reinforcing that technological innovation does not dilute statutory prohibitions or enforcement under Indian law.
