Pradyun Chakravarty Featured in The Hindu BusinessLine on SEBI’s Enforcement Framework

Pradyun Chakravarty was recently featured in The Hindu BusinessLine, where he shared his insights on the effectiveness of SEBI’s enforcement regime and the broader impact of regulatory action in market violation cases.
Commenting on the deterrent value of monetary penalties, Pradyun observed that when the financial gains from wrongdoing significantly outweigh the penalties imposed, it raises an important question as to whether such sanctions are sufficient to meaningfully influence future conduct.
He further noted that the true consequences of regulatory enforcement often extend well beyond monetary fines. Measures such as disgorgement of unlawful gains, restrictions on accessing the securities market, enhanced compliance obligations, governance reforms, and reputational damage can have a far more significant and lasting impact on regulated entities than the penalty amount alone.

Looking ahead, Pradyun emphasised that greater transparency in the manner in which SEBI determines settlement amounts, coupled with faster resolution of enforcement proceedings, would further strengthen confidence in the regulatory framework and enhance the effectiveness of market enforcement.
His observations contribute to the ongoing discourse on balancing deterrence, regulatory efficiency, and market integrity within India’s evolving securities law landscape.
