Sindhuja Kashyap Raises Concerns Over USCIS Social Media Screening Policy

Sindhuja Kashyap has voiced significant concerns over the proposed USCIS policy requiring immigrants to share their social media details. Highlighting potential constitutional and privacy issues, she warned of the risks of misinterpretation, surveillance, and infringement on fundamental rights.

“Posts may be interpreted for intent or affiliations, yet subjective analysis risks misinterpretation, infringing on First Amendment rights of the US Constitution. Data retention, likely perpetual in A-Files per DHS precedent, lacks clear statutory limits, challenging Fourth Amendment protections and potentially enabling perpetual surveillance,” she told Business Standard.
She further pointed out the lack of defined guidelines for flagging content, which could lead to arbitrary enforcement, discrimination, and a chilling effect on free speech. “Without transparent standards or appeal mechanisms, due process is undermined, disproportionately impacting vulnerable immigrants,” she emphasized.
