Sukrit Kapoor was quoted by Business Standard in its feature, “IBBI wants debt resolution professionals to guard against IBC abuse.”

Commenting on concerns surrounding the misuse of insolvency proceedings, Sukrit highlighted a March 2026 decision of the National Company Law Appellate Tribunal (NCLAT), which held that initiating corporate debt resolution proceedings to evade tax liabilities was fraudulent, malicious and impermissible.

His comments underline the importance of ensuring that the Insolvency and Bankruptcy Code, 2016 (IBC) is not used for purposes inconsistent with its intended framework.
