Sukrit’s Insights Featured in Outlook Money on Delhi High Court’s Clarification on Eviction Rights

Mr. Sukrit Kapoor, Partner, has been featured in a recent Outlook Money article analyzing the Delhi High Court’s important ruling on whether historic agreements can prevent landlords from initiating future eviction claims.

Commenting on the arguments raised in the case, Sukrit noted: “In this case, the tenants argued that the landlords’ predecessors had contractually ‘waived’ their right to seek eviction on the ground of bona fide requirement under Section 14(1)(e), and therefore the landlords were permanently barred from initiating eviction proceedings.”
He further highlighted the broader implications of the judgment, stating: “This ruling has significant practical impact: it strengthens the ability of landlords to reclaim premises when genuine need emerges, while signalling to tenants that contractual waivers cannot override statutory frameworks.”
Sukrit’s analysis highlights the judiciary’s reaffirmation that statutory rights particularly those grounded in bona fide requirement cannot be diluted or negated by prior contractual arrangements.
