Rohitaashv Sinha Comments on Labour Ministry’s Probe into TCS Onboarding Delays

As reports surface regarding the delayed onboarding of over 600 lateral hires by Tata Consultancy Services (TCS), the Ministry of Labour and Employment has confirmed that it is actively examining the issue. The matter has drawn national attention, particularly after representations from advocacy group NITES raised concerns over prolonged delays and lack of communication from the employer.

In a recent Moneycontrol article, Rohitaashv Sinha, employment law expert, noted: 

“While the central government does not have the authority to mandatorily direct a private employer such as TCS to complete the onboarding process, it may act upon representations received — such as from NITES — by initiating a fact-finding inquiry or conciliation proceedings through the Chief or Regional Labour Commissioner.” 

This observation highlights the limited but significant role of the government in protecting employee interests within the private sector. Although statutory power to compel onboarding may not exist, the Ministry’s intervention through conciliation or inquiries could help mediate a resolution and ensure fair labour practices
