Telangana RERA Rejects COVID-19 Defence in Delayed Possession Case, Says Asha Kiran Sharma

Telangana RERA has rejected a builder’s reliance on the COVID-19 pandemic and its downstream effects as a justification for delay in handing over possession to a homebuyer. Commenting on the matter, Asha Kiran Sharma said the authority’s reasoning was significant given the timeline of the transaction.

She noted that the Agreement of Sale was executed in February 2023, well after the pandemic had subsided. According to her, this meant that the builder entered into its commitment to deliver possession with full knowledge of the operating environment and could not subsequently rely on COVID-19-related disruptions to justify the delay.

The Telangana RERA order also directed the builder to pay Rs 5.04 lakh as interest compensation to the homebuyer in relation to the delayed possession and addressed a separate Rs 30,000 debris charge imposed by the builder. The decision highlights the importance of the contractual possession timeline and the circumstances existing when the agreement was entered into.
