An Accounts Executive is not a ‘workman’ under section 2(s) of the ID Act.Godrej Agrovet Limited v. The Presiding Officer and Anr., 2024 LLR 869 (Telan. HC)
Posted On - 19 February, 2025 • By - King Stubb & Kasiva
Telangana HC held that an ‘Account Executive’ would not be considered a workman under Section 2(s) of the Industrial Dispute Act. This highlights that the account executive would not be counted for the same rights workers under Section 2(s) enjoy.
Key Highlights:
- The workman is someone who primarily involves labour under the definition of Section 2(s) of the Industrial Dispute Act. This excludes supervisory or managerial positions.
- The Telangana HC held that the work of an Account Executive is primarily administrative and supervisory in nature and mainly considered as labour and thus falls outside the ambit of the workman.
- The implications can be inferred as rampant since companies can hide under the account executive post to avoid labour codes.
