Amendment To The Andhra Pradesh Labour Welfare Fund Rules, 1988
By way of notification dated 04.05.2023, certain amendments have been brought into the Andhra Pradesh Labour Welfare Fund Rules, 1988 by the addition of three new rules. It says that officers in the labour department not below the rank of Assistant Commissioner, may be appointed as authorities, or those not below the rank of Deputy Commissioner of Labour may be appointed as appellate authorities and can exercise the powers to hear appeals under the Andhra Pradesh Labour Welfare Fund Act, 1987. The procedure for filing of appeals to be followed under which, an appeal is to be presented to the appellate authority has also been enumerated, which may be filed in person or by registered post acknowledgement due in the form of a prescribed memorandum along with a certified copy of the order appealed against. The appeal shall be admitted and entered into the register of appeals and the appellate authority shall call for the connected records and fix a date to hear the appellant, after which the appellate authority shall decide the appeal, pass and communicate their order to the appellant, which may include modified quantum of punishment, or compounding the case. The penalty for violation of the rules is a fine that may extend to Rs. 25,000/- in the first instance and up to Rs. 1,00,000/- in subsequent contraventions.
