ANDHRA PRADESH GOVERNMENT CIRCULAR ON ENGAGEMENT OF WOMEN DURING NIGHT

The Office of the Director of Factories, Government of A.P, Vijayawada has issued Circular
No. LAE05-12021(31)/2/2022-BSEC-DOF dated 25 October 2022 laying down certain
additional conditions to be complied with by the employers for engaging women during
night shifts (between 7 PM and 6 AM) in factories, namely,
- The management must take written consent in advance from each woman worker who
is required or allowed to work night shift; - such employment of a woman should not violate any maternity benefit provisions
under the Maternity Benefit Act, 1961; - transportation facilities for dropping the woman from the factory to the doorstep of
the residence and for picking her up must be provided; - the workplace as well as the passage towards the basic facilities like toilets,
washrooms, drinking water, entry, exit, etc., must be properly lit; - the toilets, washrooms and drinking facilities should be near the workplace where
such woman worker is employed; - the working conditions provided must be safe, secure, and healthy and such that no
woman worker faces any sort of disadvantage relating to her employment; and - Ensure compliance with the provisions of the Sexual Harassment of Women at
Workplace (Prevention, Prohibition and Redressal) Act, 2013.
The conditions laid down by the Government by issuance of the aforesaid circular is in
continuation to the Circular No. B1/2386/2015 dated 4th April, 2015 issued by Office of the
Director of Factories, A P, which laid down that adequate safeguards shall be provided by the
managements to ensure occupational safety and health of women employees and protection
against sexual harassment, and required that amenities such as rest rooms, lunch rooms,
creche, toilet and transportation facilities shall be provided.
