The Ministry of Corporate Affairs (MCA) has issued a General Circular No. 04/2023 dated February 21, 2023[1], allowing additional time for filing the newly launched 45 e-forms on the MCA 21 Version 3.0 portal. The Ministry has allowed additional time until 31.03.2023, without any additional fee for filing these forms which are due for filing between 07.02.2023 and 28.02.2023. This comes in response to the representations received by the Ministry regarding the process of stabilization of the newly launched forms and the change in process of registration required for users on the MCA-21 portal.
The circular also states that Form PAS-03, which was closed for filing in Version 2.0 on 20.01.2023 and launched in Version 3.0 on 23.01.2023 and whose due date falls between 20.01.2023 and 28.02.2023, can also be filed without payment of additional fees until 31.03.2023. The circular further provides for an extension of the reservation period for the names reserved under Section 4(5) of the Companies Act, 2013 by a further period of 20 days. The period for resubmission under Rule 9 of the Companies (Incorporation) Rules, 2014 falling between 23.01.2023 and 28.02.2023 also stands extended by 15 days.
