The Government of India has established the Indian Cyber Crime Coordination Centre (“I4C”) with the authority of the Ministry of Home Affairs under Section 79(3)(b) of the Information Technology Act 2000 (“IT Act”). This designation empowers the I4C to address instances where information, data or communication links residing in or connected to a computer resource controlled by any intermediary are exploited for unlawful acts.

Under this framework, the I4C is authorized to notify intermediaries about such illicit activities. Upon receiving notification, intermediaries are obligated to promptly remove or disable access to the offending material. Failure to do so will result in the loss of safe harbour protection under Section 79 of the IT Act.
