Jharkhand High Court concludes that petitioner is entitled to receive arrears of salary for illegal termination

In W.P. (S) No. 605 of 2024, the Hon’ble High Court ruled that once the dismissal order was overturned, there was no justification for withholding the petitioner's salary. While acknowledging the fact that the petitioner was not allowed to work, the Court emphasized that the principle of 'no work no pay' is not applicable in this case as he was unjustly prevented from working. The court held that the petitioner is entitled for salary with effect from April 01, 1998 to April 12, 2017 and the same be released to the petitioner within six weeks.
