The Karnataka High Court rules against change in recorded date of birth post-retirement
The Karnataka High Court relying on the decision of Supreme Court in Bharat Coking Coal Limited and Others v. Shyam Kishore Singh (AIR 2020 SCC 411) has held that seeking a change in the date of birth after retirement is not permissible, especially when employee had opportunities during the service to rectify any discrepancies. It was also observed by the court that the petitioner had accepted his retirement benefit and did not raise any dispute during the service or immediately after his retirement, hence the date of birth recorded in provident fund declaration form is treated as conclusive evidence as per the standing orders applicable to him.
