Notification Regarding Exemptions Under the Haryana Shops and Commercial Establishments Act, 1958

This notification, issued by the Labour Department of the Haryana Government on March 30, 2026, exercises powers under Section 28 of the Haryana Shops and Commercial Establishments Act, 1958 (“Act”). These establishments are granted exemptions from Section 9 (opening and closing hours) and Section 10 (close day) of the Act.

Establishments wishing to employ women during night shifts, specifically between 08:00 PM and 06:00 AM, must apply for an exemption under Section 28 of the Act. This process is conducted in auto mode through self-certification, provided the establishment adheres to specific conditions outlined in a separate notification (No. 11/26/2025-4Lab) dated October 13, 2025.

The exemption is subject to strict labour regulations regarding working hours and rest periods. No person can be employed for more than 48 (forty-eight) hours in a week or 10 (ten) hours in a single day. Furthermore, the total period of work, including rest intervals, must not exceed 12 (twelve) hours a day, and any overtime work must be compensated at twice the normal wage rate.
