Rajasthan High Court: Charge-Sheets Not to Be Quashed Prematurely

In S.B. Civil Writ Petition No. 17059 of 2024, the High Court ruled against premature judicial intervention in disciplinary proceedings. The Court held that charge-sheets form part of the internal enquiry process and should not be quashed unless the issuance is patently without jurisdiction or mala fide.

Citing various judgments, including State of Orissa v. Sangram Keshari Misra and Onkar Singh Khosla v. Union of India, the Court concluded that mere allegations of factual inaccuracies in the charge-sheet do not warrant judicial review at the preliminary stage. The appropriate recourse for the employee is to submit a defence before the Disciplinary Authority.

Courts should refrain from quashing disciplinary charge-sheets unless there is a demonstrable jurisdictional error or procedural impropriety.
