Resignation not valid until acceptance of resignation is communicated to the employee
In a case where an employee was relieved from his services despite the withdrawal of the resignation, the Supreme Court of India ordered the reinstatement of the employee within 30 days from the date of the order stating that there was no clear evidence about the service of the resignation acceptance letter by the employer. The decision emphasized the requirement to communicate the acceptance of the resignation letter by the employer. The court also ordered 50% salary for the period between the relieving date of the employee and the date of reinstatement along with continuity of service for pensionary benefits.
