Simplification of procedure for extension of Certificate of Coverage (“COC”) cases under Article 7.2 of the Social Security Agreement between India and Japan

[1]Following a bilateral meeting between Indian and Japanese authorities, the EPFO has introduced a simplified procedure for extending the Certificate of Coverage (“COC”) under the Social Security Agreement (“SSA”). This update aims to enhance the Ease of Doing Business and Ease of Living by streamlining the administrative process for international worker detachment. Under the new guidelines, extensions for a total duration of 5 (five) to 8 (eight) years can now be granted without formal consultation between the two nations, provided the reasons fall under specific conditions such as project delays, successor issues, a child’s schooling needs, or the worker’s approaching retirement.

The procedural workflow has been decentralized to significantly reduce delays, authorizing Regional Offices in India to issue COCs directly upon request. The previous requirement to obtain a No Objection Certificate (“NOC”) or consent from Japanese authorities via the Head Office has been eliminated for cases meeting the specified criteria. For pending cases where a consultation request was sent but no NOC was received, Regional Offices are instructed to issue the COC immediately under these transitional provisions, while maintaining transparency through information sharing between liaison agencies.

To ensure effective implementation, Regional Offices must publicize these guidelines and verify the completeness and accuracy of all documentation. Offices are required to maintain meticulous records and submit monthly reports on issued COCs to the International Cooperation for Social Security Division (“ICSSD”). This oversight ensures that while the process is expedited at the local level, the Head Office continues to monitor the system and share necessary data with Japanese authorities to maintain the integrity of the bilateral agreement.
