Dhruv Kaushal, Partner Data Privacy Practice, was recently featured in Deccan Chronicle, where he provided expert commentary on one of the most significant aspects of India’s evolving data protection regime that is the transfer of personal data outside India.

The article examines the implications of the Digital Personal Data Protection Act, 2023 (DPDP Act) and the government’s approach towards cross-border data transfers. Commenting on the framework, Dhruv observed: “The DPDP law says that data can be freely transferred outside India. However, data cannot be transferred to blacklisted countries. So ultimately, who these blacklisted countries are, that is a question which the government has not answered yet.”

His remarks highlight a key area of regulatory uncertainty that businesses and multinational organisations continue to monitor closely as India advances the implementation of its data protection framework.
