Rohitaashv Sinha Comments on Retrospective Effect of Revised Bonus Wage Ceiling

Commenting on the Ministry of Labour and Employment’s notification fixing ₹21,000 per month as the wage ceiling for statutory bonus eligibility, Rohitaashv Sinha highlighted the implications of its retrospective application.

Speaking to Moneycontrol, Rohitaashv noted that the notification, issued under Section 26(1) of the Code on Wages, 2019, is deemed to have come into force retrospectively from November 21, 2025, when the four new labour codes took effect.
He observed that this means employers have effectively been operating for the past nine months without formal clarity on the threshold and must now reconcile payroll and bonus computations retrospectively.
