Mr. Ashish Kothari is a Partner and heads the Agrochemicals & Insecticides Practice of the Firm. His core areas of practice include Seeds and Insecticide laws, laws relating to Pharmaceuticals and Healthcare, Competition Law, Medical Negligence and Consumer Protection. He has more than 10 years of experience in strategizing and handling complex litigations before various forums including the Supreme Court of India and various High Courts.

Litigation

Drafted original suits and petitions, interlocutory applications, criminal complaints, notices, reply to notices, etc., briefed senior counsels and appeared before the Supreme Court, various High Courts as well as lower courts, Competition Commission of India, National Company Law Tribunal at Delhi, National Company Law Appellate Tribunal, National Consumer Disputes Redressal Commission. He also has substantial experience in handling Domestic as well as International Arbitration proceedings.

  • Successfully represented Pesticides Manufacturers & Formulators Association of India in a writ petition filed before the Hon’ble Delhi High Court seeking directions to the Ministry of Agriculture & Farmers Welfare to disclose all relevant reports and documents that formed basis for issuance of a Gazettee Notification banning 27 insecticides.
  • Successfully represented Crop Care Federation of India in a writ petition filed before the Hon’ble Delhi High Court seeking directions to the Ministry of Agriculture & Farmers Welfare to disclose all relevant reports and documents that formed basis for issuance of a Gazettee Notification restricting sale and use of the insecticide “Glyphosate”.
  • Filed a writ petition before the Hon’ble Delhi High Court on behalf of the Rajasthan Equestrian Association for directions to the Equestrian Federation of India (“EFI”) to comply with the Sports & Development Code, 2011 and highlighting the illegal appointment of President and Vice President of the EFI based on their ranks in the Indian Army.
  • Filed a writ petition before the Hon’ble Delhi High Court on behalf of a 14 year old Equestrian athlete challenging the decision taken by EFI to prohibit her from participating in the Junior National Equestrian Championship.
  • Filed a complaint before the Competition Commission of India on behalf of various volleyball players in relation to anti-competitive Agreement between Volleyball Federation of India and another company.
  • Successfully defended a major fashion house against a petition filed under S. 9 of the Arbitration & Conciliation Act, 1996 for securing the amount claimed by the Petitioner.
  • Filed a writ petition before the Hon’ble Delhi High Court on behalf of DMA Nursing Home & Medical Establishment Forum challenging arbitrary appointment of Bar Code Vendors for collection of Bio-medical waste from hospitals and nursing homes.
  • Has been advising and representing several home buyers aggrieved by actions of the Builders before RERA Authorities and Consumer Forums.
  • Filed a writ petition before the Hon’ble Delhi High Court on behalf of Crop Care Federation of India, Crop Life India and other Agro-chemical companies challenging amendments made to labelling and packaging requirements provided under the Insecticides Rules, 1971.
  • Filed a writ petition on behalf of Crop Care Federation of India and its member companies before the Hon’ble Bombay High Court challenging a ban on “co-marketing arrangements” by the Maharashtra Govt.
